mark kelly. a ban on large capacity magazines he said may have injured the gunman from taking his wife's life when he took six drives. >> when he tried to reload, he dropped the magazine and a woman grabbed it and it gave bystanders a time to tackle him. >> reporter: republican lindsay lindsey graham offered a counter example of a woman running out of bullets defending herself. some democratic senators have introduced legislation to ban high capacity magazines and assault style weapons, expanding background checks also up for debate. >> my problem with background checks is you're never going to get criminals to go through universal back ground checks. >> reporter: wayne lapierre pressed the nra's position. >> the criminals won't go to purchase the guns because there will be a background check. we'll stop them from the original purchase. you miss that point completely and i think it's basic. >> senator, i think you missed it. >> let there be order. >> reporter: getting any new legislation passed is expected to be difficult. there are gun rights supporters on both sides of the aisle.

to protect our families. >> giffords' husband, retear astronaut mark kelly, also testified urging congress to strengthen the laws. there was also talk of guns in school security today in richmond. the virginia house of dole gas approved a bill to let private schools hire armed security guards. it's barred under the current law. kate corey spoke out again the idea saying they don't have enough training. >> mr. speaker, we cannot approve sending such poorly trained armed guards into our private schools and daycare centers. we are inviting disaster. >> we are talking about private schools on private property. it could be left up to them to decide what they need for their security and not micromanage from here. >>> the virginia house approved that measure by a 72-25 vote. it's now headed to the senate. under this bill, child daycare centers would be able to hire armed guards. >>> we're following more big stories at this hour. drivers breaking the law in the district, and our transportation reporter found it's happening over and over again. find out why it's also putting cyclists in danger. >>>

testified as did her husband, former space shuttle commander mark kelly talking about how there needs to be gun restrictions. kelly talking about how he is a gun owner. he and gabrielle giffords are both gun owners and believe in the second amendment and right to bear arms but there needs to be a conversation about gun violence. he talked about the need for better background checks in this country and eliminating restrictions on data. i want to bring in our chief congressional correspondent dana bash who is in the hearing room. one of the things we heard about a few minutes ago was about going after straw purchasers. could you explain to our viewers what exactly are straw purchasers and this is an area of legislation where there might be some accomplishment? >> reporter: if you listen to the line of questioning that the chairman patrick leahy is going through, you sort of see kind of the wheels churning and the outlines of potential legislation that he might be thinking it. it's all focused on background checks and making sure that guns are not in the hands of the wrong people. he tal

and there is her husband, mark kelly. he testified as well. among those speaking out against this assault weapons ban was wayne lapierre, the executive vice president of the national rifle association. >> we need to be honest about what works and what does not work. proposals that would only serve to burden the law abiding have failed in the past, and they'll fail again in the future. semi-automatic firearm technology has been around for 100 years. they're the most popular guns for hunting, target shooting, self-defense. despite this fact, congress banned the manufacture and sale of hundreds of semi-automatic firearms and magazines from '94 to 2004. independent studies, including one from the clinton justice department, proved that had no impact on lowering crime. when it comes to background checks, let's be honest, background checks will never be universal because criminals will never submit to them. there are a lot of things that can be done and we ask you to join with us. the nra is made up of millions of americans who support what works. the immediate protection of all, not just our schoolchi

. also mark kelly, gabby give order's husband is going to be there. >> the law enforcement issue is not being addressed. 35% less convictions on guns since the bush administration. here i'm back on bush. and also 76,000 people last year were denied on background checks denied guns. 62 referred for prosecution. they have a point. more laws is that going to cover this thing? and frankly, we're not addressing the mental issues of this. we're putting up the ban date without any adhesive by creating more laws. >> look, it's always difficult to pass gun control laws in congress in the united states. >> even after what happened in connecticut. >> but i think there's a possibility you get more on the background check side. gun shows, that's the biggest freaking loophole. got to solve that problem. seems to me, who needs 20 bullet magazines to shoot a deer? sorry. don't think so. >> we will not solve all the problems here. but hopefully congress and the president can get something done. thanks so much for coming in. we'll be right back after the break.  >>>
